General conditions
PREAMBLE
These General Conditions govern the terms of subscription and use of the different class packages offered by Force Vive Pilates to its clients, as well as the use of this website. By consulting it, you accept the terms of use described below. Force Vive Pilates reserves the right to modify its general conditions at any time without notice. In such cases, the applicable conditions will be those in effect, i.e., those displayed on the website at the time of the class purchase.
INTERNAL REGULATIONS
Force Vive Pilates reserves the right to terminate a package, refuse a registration, access, or class purchase if the Client does not comply with one of the provisions of these internal regulations.
CLOTHING REQUIREMENTS
For all classes provided by Force Vive Pilates, the Client must wear appropriate attire, such as light, comfortable, and/or sportswear, used exclusively for the class. Wearing socks is mandatory. The Client must wipe their feet and remove their shoes at the studio entrance.
BEHAVIOR
The Client cannot use the equipment and facilities provided without adhering to the internal regulations, instructions, and the teacher’s hygiene and safety guidelines. The Client must refrain from having aggressive, indecent, or immoral behavior.
HYGIENE
• Available: antiseptic gel or hydro-alcoholic solution for handwashing.
• Between each class, surfaces and equipment are disinfected, and the premises are aired.
CLIENTS
• The Client acknowledges and accepts that they must follow the instructions and other directives provided. The Client acknowledges and accepts that engaging in sports activities involves risks and has taken appropriate measures to prevent such risks, for which Force Vive Pilates cannot be held responsible. Force Vive Pilates reserves the right to deny a Client access to one or more classes if they deem the Client’s physical condition inadequate to perform the exercises correctly, especially without injury risk. The Client agrees to inform Force Vive Pilates of any specific medical issues or pregnancy, as certain exercises or treatments might be contraindicated. The Client must have a medical certificate authorizing them to practice Pilates, and Force Vive Pilates may request a copy.
• Minor Clients: Any minor must provide parental authorization for registration. This authorization must be handed in person or sent by email along with a copy of the legal guardian’s ID.
CLASS PACKAGES
The Client can pay for classes individually or purchase a class package. Each package has a determined validity period. It is not possible to exchange one class package for another.
PRICES
The applicable prices are those in effect at the time of purchase and displayed on the website. Prices are indicated in euros, including VAT at the applicable rate. Force Vive Pilates reserves the right to change its prices at any time, with the understanding that the price displayed on the website at the time of purchase will be the only one applicable.
PAYMENT
Classes are paid for in advance on the online booking site via credit card. The Client’s order confirmation implies acceptance of these terms and conditions, acknowledgment of full knowledge, and waiver of their own purchasing conditions or others. All provided data and the recorded confirmation will serve as proof of the transaction. The confirmation will act as a signature and acceptance of the transactions made. Force Vive Pilates will confirm the order via email. No class, whether purchased individually or in a package, is eligible for a refund regardless of the reason (except in case of billing or payment errors). If a refund is required due to a payment or billing error, the amount paid will be refunded to the Client within 21 working days from the claim. Any costs incurred due to payment issues will be borne by the Client.
Payment by credit card uses an online payment security system that guarantees the total confidentiality of the Client’s banking information. The credit card transaction is entirely encrypted and protected, meaning the Client’s banking details are not stored digitally by Force Vive Pilates. The Client guarantees that they have the necessary authorization to use the payment method when placing the order.
RETURN POLICY
In accordance with Article L. 221-28 12° of the Consumer Code, the Client expressly acknowledges and accepts that they do not benefit from a withdrawal right for Services reserved from the Site, as these Services concern leisure activities to be provided on a specific date or period.
RESERVATION AND CANCELLATION CONDITIONS
Access to classes will only be possible after prior payment of the relevant class. A class can be canceled up to 12 hours before the start of the class via email (forcevivepilates@gmail.com) or the contact form on the website. A class canceled less than 12 hours before the start will not be refunded (for individual classes) or will be deducted from the class package and cannot be refunded. Packages are personal; only the person who purchased them may use them, and they cannot be transferred, given, or passed on to a third party.
SCHEDULE MODIFICATION
Group classes require a minimum of 2 participants. Force Vive Pilates reserves the right to cancel a class if the instructor is exceptionally unavailable. In this case, the session will be credited to the client’s account. Whenever possible, clients will be notified of any cancellations or changes as soon as possible.
TERMINATION AND EXPIRATION OF ENROLLMENTS
Packages cannot be terminated before their expiry date by the client. Force Vive Pilates reserves the right to terminate a package, refuse a registration, access, or class purchase if the client fails to comply with any provision of these general conditions or the internal regulations. Packages and classes cannot be refunded for any reason however in exceptional cases (pregnancy, injury with doctor’s note), the duration may be exceptionally extended on a case by case basis determined by Force Vive Pilates. In all other cases, the package duration will not be extended if the client does not use all the courses within the allocated time. Unused classes will be lost and will not be refunded.
CIVIL LIABILITY / BODILY INJURY
Force Vive Pilates is insured for damages involving its civil liability and that of its staff in accordance with Article L.321-1 of the Sports Code, with Allianz Insurance. This insurance is intended to cover the Client against financial consequences for damages caused to others due to its operations: bodily, material, and immaterial damages. Force Vive Pilates cannot be held liable for accidents resulting from the Client’s failure to observe safety instructions or inappropriate use of the equipment or facilities.
Force Vive Pilates cannot be held responsible for any failure or poor performance of any part of the services provided under the contract, attributable either to the Client, to an unforeseeable and insurmountable event caused by a third party, or to a case of force majeure.
DISPUTES
No specific condition or document can prevail over the general conditions and internal regulations unless formally accepted in writing by Force Vive Pilates. Any contrary condition set by the Client will be unenforceable against Force Vive Pilates.
In the event of a dispute between the Client and Force Vive Pilates, an amicable solution will be preferred. If unsuccessful, any dispute between the Client and Force Vive Pilates will be submitted to the competent Courts.
